5.8 THE EXCLUSION OF LIABILITY PURSUANT TO ARTICLES 5.1 TO 5.7 OF THESE TERMS OF USE DOES NOT APPLY IF THE DAMAGE IS CAUSED WILLFULLY OR BY GROSS NEGLIGENCE BY US OR UNLESS WE SHOULD BE LIABLE OTHERWISE PURSUANT TO THE AUSTRALIAN CONSUMER LAW OR OTHER MANDATORY LEGAL PROVISIONS SUCH AS PRODUCT LIABILITY PROVISIONS. MOREOVER, THE EXCLUSION OF LIABLITY DOES NOT APPLY TO DAMAGE FROM INJURY TO LIFE, BODY OR HEALTH (PERSONAL INJURIES).
5.9 Different limitations and exclusions of liability will apply to liability arising as a result of the sale of any La Prairie products by us to you. These limitations and exclusions are set out in our Terms and Conditions of Sale.
5.10 No clause of these Terms of Use, other than clause 5.11, limits our liability to you under the Australian Consumer Law for breach of the consumer guarantees set out in Division 1 of Part 3-2 of the Australian Consumer Law. Additionally, clause 5.2 will not apply if a party establishes that reliance on it would not be fair and reasonable.
5.11 Our liability for failure to comply with a consumer guarantee (other than a guarantee under section 51, 52 or 53 of the Australian Consumer Law) which applies to a good or service supplied under this Agreement which is not of a kind ordinarily acquired for personal, domestic or household use or consumption is, to the extent permitted by law, limited to:
(a) in the case of goods, to any one of the following as determined by us:
(i) the replacement of the goods or the supply of equivalent goods; or
(ii) the payment of the cost of replacing the goods or of acquiring equivalent goods; and
(b) in the case of services, to any one of the following as determined by us:
(i) the supply of the services again;
(ii) the payment of the cost of having the services supplied again.
5.12 The remaining provisions of this clause 5 do not apply to regulate liability under the Australian Consumer Law for breach of the consumer guarantees.
6. Viruses
6.1 We do not guarantee that our Website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our Website. We recommend that you use your own virus protection software.
6.2 You must not misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. 5.1.2 We only supply Products (including any free samples provided with your order or handed over at La Prairie Boutiques) for domestic and private use. You may not buy Products from us, neither on our Website nor in La Prairie Boutiques, for resale or any other commercial purposes.
5.2 Purchase on our Website
5.2.1 If you order our Products on our Website our ordering process allows you to check your order and amend any errors before submitting your order of our Products to us. Please take the time to read and check your order at each stage of the ordering process. In particular, please check the quantities, sizes and weights of each of the Products in your order.
5.2.2 By clicking the "Submit order"-button you are committing to buy and pay for the Products in your order. The Contract will be subject to these Terms and Conditions. By placing the order, you confirm at the latest that you accept these Terms and Conditions.
5.2.3 The submitted order is an offer from you to us to enter into a Contract to buy the Products in your order. Your offer may be rejected by us. After you place an order, you will receive an email from us acknowledging that you have placed an order. Please note that this does not mean that your order has been accepted. The Contract is only concluded when we send you a separate email with shipping confirmation ("Shipping Confirmation").
5.2.4 Only the Products listed in the Shipping Confirmation are included in the Contract between you and us. If there are any errors in your Shipping Confirmation, please contact us as soon as possible using the form on the Contact Us page on our Website (available at Contact Us).
5.2.5 If we are unable to supply you with a Product (because, for example, that Product is not in stock or is no longer available) we will inform you of this by email. If you have already paid for the Product(s), we will refund you the full amount. Further liabilities are excluded.
6. Product prices
6.1 The prices of the Products will be as shown in La Prairie Boutiques (if you buy the Products there) or as quoted on our Website at the time of your purchase or order (when you buy online). In case we have to ship the Products to you, the prices are subject to applicable delivery charges.
6.2 We take all reasonable care to ensure that the prices of the Products displayed in La Prairie Boutiques or shown on our Website are correct. However, it is always possible that, despite our efforts, some of the Products may be incorrectly priced. If the price for the Product displayed in La Prairie Boutiques is obviously incorrect, we have the right to withdraw from the Contract. In this case, once you have returned the Products to us, we will refund you the paid price, if applicable. You will have the opportunity to purchase the Products at the right price. If we discover an obvious error in the price of the Products you have ordered online we will contact you to inform you of this error and we will give you the option of continuing to purchase the Products at the correct price or cancelling your order. Even if a Shipping Confirmation has already been sent to you, we do not have to provide the Products to you at the incorrect price and, in any case, reserve the right to withdraw from the Contract. We will not process or ship your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat your order as cancelled.
6.3 The prices of the Products may change from time to time, either on our Website as well as in La Prairie Boutiques. Such price changes will not affect any order on our Website which we have confirmed with a Shipping Confirmation. In case of pricing errors, art 6.1 and 6.2 of these Terms and Conditions apply.
7. Methods of payment
7.1 You can pay for Products using a credit card, AliPay, WeChat Pay, Apple Pay, Google Pay or PayPal. We accept the following cards: Visa, MasterCard, American Express and China Union Pay.
7.2 By ordering Products from us, either through our Website or in La Prairie Boutiques, you authorise us to perform credit and anti-fraud checks on you and the payment method that you have chosen. These checks may be required, amongst other things, to verify your identity, to validate your credit or debit card, to obtain an initial credit or debit card authorisation and/or to authorise individual purchases. You authorise us to disclose information provided by you, including personal information, to third parties such as banks and the providers of credit reports for the purposes of these checks. You accept that such parties may keep a record of that information. You also agree that we may make the information we receive from such checks available to third parties including fraud prevention and credit reference agencies. 7.3 If the amount due from you for your order cannot be debited or charged, for whatever reason, your order will be cancelled (we will try to notify you of this using the contact details you provided during the order process).
7.4 If we have to ship your purchase or order, your debit card or credit card will not be charged until we ship your purchase or your order (at which point we take payment for the Products and all applicable delivery charges in full).
8. Delivery of your purchase or your order of our Products
8.1 Your order will be fulfilled by the estimated delivery date set out in the Shipping Confirmation, unless there is an event outside of our control (please see section 13 below for more information about these events). If we are unable to meet the estimated delivery date because of an event outside of our control, we will contact you with a revised estimated delivery date.
8.2 Delivery will be completed and our obligations are fulfilled when the Products are successfully delivered to the address you gave us. After delivery, the risk of accidental deterioration and accidental loss of the Products passes on to you. Please make sure that the delivery details you provide are accurate as we cannot be responsible for any delayed or failed deliveries as a result of your error. We will only deliver to residential addresses or offices with a street address and a person with authority to accept delivery of the order. We do not deliver to post office boxes, parcel lockers, parcel pick-up services, freight forwarding companies, and the like, and we reserve our right not to process orders with such addresses made through our systems.
8.3 If you order Products from our Website for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount. You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.
8.4 You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such laws or regulations.
9. Returns and refunds
General returns
9.1 We want you to be completely satisfied with the Products you have ordered from us. If you have any problems with the Products you have ordered, please contact our customer services team using the form on the Contact Us page of our Website (available at Contact Us). Details of your legal right to cancel your Contract with us, and an explanation of how to do this, are set out below and provided in the Order Acceptance that we send to you.
9.2 You may return Products to us and receive a full refund of the price paid for the Products provided that you return the Products to us (or notify us of your intention to do so) within 30 days of the Products being delivered or handed over to you. The goods must be in their original packaging, complete with all accessories and accompanied by the invoice, the completed delivery note/return slip, and any guarantee certificate, if applicable. Sealed and plastic-welded products can only be returned when unopened.
9.3 If you want to return Products to us, please tell us by contacting our customer service team on 1-800-649-849 or by sending an email to Customer Service. We will send you an email to confirm that we have received your return request. You may wish to keep a copy of this (and any emails you send to us) for your own records.
9.4 You will receive a full refund of the price you paid for the Products and any applicable delivery charges you paid for. We will process the refund due to you as soon as possible and, in any case, within 30 days of the day on which you contacted us (as described in section 9.3 above). We will refund you on the credit card or debit card that you used to pay.
9.5 In order to receive your refund, you must return the Products to us as soon as reasonably possible. Unless the Products are faulty or not as described (in which case, section 9.6 below will apply), you will be responsible for the cost of returning the Products to us. You are responsible for taking reasonable care of the Products until they are returned to us. We recommend that you return them to us using a recorded delivery service and that you keep proof of postage. We will be unable to provide you with a full refund if the Products are not returned to us or if they are damaged when they arrive.
Faulty Products
9.6 In the unlikely event that the Products we sell to you are faulty or not as described, you may have additional legal rights to receive a refund in relation these Products, including under the consumer guarantees in the Australian Consumer Law. These legal rights are not affected by our general returns policy (set out above) or by these Terms and Conditions. 10. Our liability
10.1 To the extent permitted by law and without affecting your rights under the Australian Consumer Law, neither you nor we and our affiliates, officers, directors, affiliates, agents, contractors, representatives, interns, suppliers, service providers, or licensors are liable to the other for any punitive, special, exemplary, indirect or consequential damages arising from these Terms and Conditions or the website, or for any damages related to the loss of profits; loss of savings, loss of revenue, loss of business, loss of use, loss of goodwill or loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable and even if we have been advised of the possibility of such damages
10.2 Neither you nor we have liability to the other for any damage, loss of profit, loss of business, business interruption, or loss of business opportunity or provide compensation for third party liability. This provision in particular applies if you fail to comply with your obligation to not use our Products for any commercial, business or re-sale purposes (c.f. article 5.1.2 of these Terms and Conditions).
10.3 Furthermore, we are neither liable for improper storage or use of our products nor for storage or use of our Products contrary to these Terms and Conditions, contrary to our reasonable instructions or contrary to statutory provisions.
10.4 We are not liable for any losses caused to you as a result of any delay or failure by us to perform our obligations where such delay or failure is due to an event which is outside of our reasonable control pursuant to article 13 of these Terms and Conditions.
10.5 The exclusion of liability pursuant to articles 10.1.1 and 10.2 to 10.4 of these Terms and Conditions does not apply if the damage is caused wilfully or by gross negligence by us or unless we should be liable otherwise pursuant to the Australian Consumer Law or other mandatory legal provisions such as product liability provisions. Moreover, the exclusion of liability does not apply to damage from injury to life, body or health (personal injuries).
10.6 No clause of these Terms of Use, other than clause 10.7, limits our liability to you under the Australian Consumer Law for breach of the consumer guarantees set out in Division 1 of Part 3-2 of the Australian Consumer Law. Additionally, clause 10.7 will not apply if a party establishes that reliance on it would not be fair and reasonable.
10.7 Our liability for failure to comply with a consumer guarantee (other than a guarantee under section 51, 52 or 53 of the Australian Consumer Law) which applies to a good or service supplied under this Agreement which is not of a kind ordinarily acquired for personal, domestic or household use or consumption is, to the extent permitted by law, limited to:
(a) in the case of goods, to any one of the following as determined by us:
(i) the replacement of the goods or the supply of equivalent goods; or
(ii) the payment of the cost of replacing the goods or of acquiring equivalent goods; and
(b) in the case of services, to any one of the following as determined by us:
(i) the supply of the services again;
(ii) the payment of the cost of having the services supplied again.
10.8 The remaining provisions of this clause 10 do not apply to regulate liability under the Australian Consumer Law for breach of the consumer guarantees.

13. Events outside of our control
13.1 In rare circumstances, events outside of our reasonable control may delay or prevent us from performing our obligations. If these events occur, we will try to perform our obligations to you as soon as we can. We cannot, however, accept liability for any losses caused to you as a result of any delay or failure by us to perform our obligations where such delay or failure is due to an event which is outside of our reasonable control.
13.2 If an event outside of our reasonable control takes place that affects the performance of our obligations under the Contract:
13.2.1 we will try to contact you as soon as reasonably possible to notify you; and
13.2.2 our obligations will be suspended and the time for performance of our obligations will be extended for the duration of the event outside of our reasonable control. Where the event outside of our reasonable control affects delivery of Products to you, we will arrange a new delivery date with you after the event outside of our reasonable control is over.
14. Changes to these Terms and Conditions
14.1 We may make changes to these Terms and Conditions from time to time (if, for example, we have made changes to how we accept payment from you, or if there is a change in the law that means we need to change these Terms and Conditions).
14.2 Every time you make a purchase in La Prairie Boutiques or order Products from our Website, the Terms and Conditions in force at that time will apply to the Contract between you and us. The current version of these Terms and Conditions will be available on our Website or in La Prairie Boutiques. Please check the Terms and Conditions each time that you purchase or order Products from us to ensure that you understand the Terms and Conditions that apply at the time.
15. Complaints
We hope that you don't have cause for a complaint but, if you do, we want to hear about it so that we can try and resolve it and make sure it doesn't happen again. Please contact our client services team using the form on the Contact Us page on our Website (available at Contact Us). If you have bought the Product in one of our La Prairie Boutiques you can also visit La Prairie Boutiques and tell us your complaint in person.
16. Other important information
16.1 We may transfer our rights and obligations to another organisation, but this will not affect your rights or our obligations under these Terms and Conditions.
16.2 The Contract is between you and us. No other person shall have any rights to enforce any of its terms.
16.3 Each of the articles of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are the invalid, void or unenforceable, the remaining articles will remain in full force and effect. In such a case, we will agree on a valid and enforceable provision that comes as close as possible in economic terms to the invalid, void or unenforceable provision.
16.4 If we fail to insist that you perform any of your obligations under these Terms and Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
16.5 These Terms and Conditions together with the Shipping Confirmation constitute the entire agreement between you and us regarding its subject matter and they supersede any and all earlier agreements between you and us concerning the subject matter hereof.
17. Governing law and jurisdiction
17.1 These Terms and Conditions are governed by substantive Australian law, to the exclusion of the UN Convention on Contracts for International Sale of Goods and the conflict of law rules.
17.2 You and we both agree that the courts of New South Wales, Australia (and any courts with appellate jurisdiction therefrom), will have exclusive jurisdiction in any dispute arising out of, or in connection with these Terms and Conditions. This is not applicable in case the dispute concerns a consumer contract. In such a case the court at your domicile or our registered office will have jurisdiction for actions brought by you. If we bring actions, the court at your domicile will have exclusive jurisdiction.

1. REGISTRATION
1.1. The registration fee for the Virtual Masterclass (“Event”) is specified at the time of booking (“Fee”).
1.2. The Fee is non-refundable (unless required to be refunded under the Australian Consumer Law), and redeemable in a single transaction only on La Prairie products available and sold on the La Prairie Australia official eBoutique (www.laprairie.com/en-au/).
1.3. Attendance at the Event is by invitation only and cannot be cancelled, transferred, or rescheduled.
1.4. If a participant is unable to attend the Event, the participant agrees that the Fee is forfeited. At its own discretion, La Prairie may allow cancellations on a case-by-case basis. If the participant received a registration gift; upon the successful registration of the Event, the cancellation shall only be accepted if the registration gift is returned to La Prairie within 10 business days in the original condition as received prior to the Event. In case of a cancellation request, please contact customer.service@laprairie.com.au.
2. PARTICIPATION IN THE EVENT
2.1. Client is not entitled to make or have made commercial image, video or sound recordings. All information and intellectual property rights shared by La Prairie at the Event belongs to La Prairie.
2.2. La Prairie may reschedule or cancel the Event in their sole discretion for any reason. In such cases, La Prairie will use its best efforts to notify the participants, reschedule the Event and/or refund the Fee.
2.3. The Event is a private Event, and La Prairie reserves the right to exclude an individual from the Event for reasonable grounds in their sole discretion and refund any Fee paid.
3. VOUCHER CODE
3.1. Upon registration, Participants will receive a voucher code in the amount of the Fee (“Voucher Code”). The Voucher Code is only redeemable for purchases at the La Prairie Australia official eBoutique (www.laprairie.com/en-au/) and will remain active for 30 days following the Event. Voucher codes not redeemed during this time frame will be forfeited.
3.2. The Voucher Code can only be redeemed one time per Participant in a single transaction and is non-transferable.
3.3. The Voucher Code cannot be exchanged for cash and must be used in conjunction with a product purchase. If the purchase does not exceed the value of the Fee, any remaining balance is forfeited.
3.4. If a participant exercises a return policy for a product purchased using the Voucher Code, and the refund is not because the products were faulty or not as described, the value of the Voucher Code will not be refunded. Only the balance of the purchase minus the Voucher Code value is subject to the return policy, at the organizer’s discretion.
3.5. If a Client is entitled to register a guest for the Event, the guest will receive a separate Voucher Code upon registration.
