When you conclude a Contract at the Maison La Prairie, you may choose whether you would like to take the purchased Products home with you based on availability. Any orders over 500.00 CHF may also be delivered to your Swiss address. The Contract in both cases shall be subject to these Terms and Conditions.
5.2.2 Transfer of Risk
If you choose to take the purchased Products home with you, all use and risk shall be transferred to you as soon as the Products are handed to you. If you choose for the Products to be delivered to your Swiss address, all use and risk shall be transferred to you as soon as the ordered Products are handed over to the transport service provider.
5.3 Ordering on our Website
5.3.1 If you order any Products on our Website, our ordering process allows you to review your order and correct any errors before submitting your order. Please take the time to review your order during each stage of the ordering process. In particular, please review the quantities, sizes, and weights of the individual Products in your order.
5.3.2 By clicking the Submit Order button, you undertake to purchase and pay the Products or Services contained in your order. The Contract is subject to these Terms and Conditions. At the latest when submitting your order, you confirm that you agree to these Terms and Conditions.

6. PRODUCT AND SERVICE PRICES
6.1 The prices of the Products and Services are as stated at the Maison La Prairie (if you purchase the Products or Services there) or as quoted on our Website at the time of your purchase or order (in case of online purchases). All prices are in Swiss Francs (CHF) inclusive of VAT. In case we have to ship the Products to you, the prices shall be subject to applicable delivery charges.
6.2 We take all reasonable care to ensure that the prices of the Products displayed at the Maison La Prairie or shown on our Website are correct. However, it is always possible that, despite our efforts, some of the Products or Services may be incorrectly priced. If the price for the Product or Service displayed in at the Maison La Prairie is obviously incorrect, we shall reserve the right to withdraw from the Contract. In that case, we shall refund you the paid price, if applicable, once you have returned the Products to us. You shall have the opportunity to purchase the Products and Services at the right price. If we discover an obvious error in the price of the Products or Services you have ordered online, we shall contact you to inform you of this error and give you the option of continuing to purchase the Products at the correct price or cancelling your order. 7. PAYMENT METHODS
7.1 When you order Products or Services on our Website, you may pay for the Products and Services you have ordered using one of the payment methods listed on our Website at the time of the checkout process.
7.2 When shopping at the Maison La Prairie, you may pay in cash or by credit card. We recommend using a credit card for any payments over 10,000.00 CHF. We accept payment in Euros and Swiss Francs. If you choose to pay in Euros, you shall receive any change in Swiss Francs at the current exchange rate.
7.3 By ordering Products or Services from us, either on our Website or at the Maison La Prairie, you authorise us to perform credit and anti-fraud checks on you and the payment method that you have chosen. These checks may be required, amongst other things, to verify your identity, to validate your credit or debit card, to obtain an initial credit or debit card authorisation, and/or to authorise individual purchases. You authorise us to disclose information provided by you, including personal information, to third parties such as banks and credit agencies for the purposes of these checks. You agree that such parties may keep a record of that information. You also agree that we may make the information we receive from such checks available to third parties including fraud prevention and credit reference agencies. 7.4 If the amount due for your order cannot be debited or charged for any reason, your order shall be cancelled (we shall try to notify you of this using the contact details you provided during the order process).
7.5 If we must ship your purchase or order, your debit card or credit card shall not be charged until your purchase or your order has been shipped (at which point we take payment for the Products and all applicable delivery charges in full).
8. DELIVERY OF YOUR PURCHASE OR ORDER
8.1 Please note that we do our best to ensure that your order shall be completed by the expected delivery date stated in the Shipping Confirmation or confirmed during your purchase at the Maison La Prairie, assuming prompt and proper delivery by our suppliers. If the delivery is help up due to force majeure (for more information, please see Article 13 of these Terms and Conditions), this shall not be considered a delay in delivery. If we are unable to meet the estimated delivery date because of an event beyond our control, we shall contact you with a revised estimated delivery date.
8.2 Delivery shall be completed and our obligations fulfilled when the Products are successfully delivered to the address specified by you. After delivery, the risk of accidental deterioration and accidental loss of the Products is transferred to you. We shall not be liable for any faults of the transport service provider. Please make sure that you provide an accurate delivery address, as we cannot be responsible for any delayed or failed deliveries as a result of your error.
8.3 If not all the Products you have ordered are in stock, we may make partial deliveries. If, for reasons beyond our control, any or all Products cannot be delivered after the Contract has been concluded, you and we may withdraw from the Contract governing the delivery of the pending Products. We shall inform you about any such delivery problems and await your further instructions. If we do not receive any further instructions from you within 30 days, we shall withdraw from the Contract. If you or we withdraw from the Contract, we shall refund you the price paid for the pending Products, if applicable.
8.4 Our online store is exclusively aimed at persons who are permanent residents of Switzerland and have a domestic delivery address. Shipping outside of Switzerland is not possible.
8.5 You must comply with all applicable laws and regulations of the country for which the Products are destined. We shall not be liable or responsible if you break any such laws or regulations.
9. RETURNS AND REFUNDS
9.1 We want you to be completely satisfied with the Products you have purchased from us via our Website or at the Maison La Prairie. If you have any problems with the Products you have purchased, please contact our customer services team using the form on the contact page of our Website (available under Contact Us). If you purchased your Product(s) at the Maison La Prairie, please come and see us there in person.
9.2 You may return Products to us and receive a full refund of the amount paid for the Product, provided you return the Products within 30 days from the day the Products were delivered or handed over to you. The Product(s) must be returned in its original packaging and include all accessories, the invoice, the completed delivery note/return form, and a warranty certificate, if any. Products that are sealed and wrapped in plastic may only be returned if unopened.
9.3 If you want to return Products to us, please follow the steps below: • For purchases made on our Website: o Please return the Products together with the completed return form and use the return label included with your order. o You shall receive a full refund for the price paid for your Products and all applicable delivery fees. We shall process the refund as fast as possible but no later than 30 calendar days after the day on which we received the returned Product. We shall refund the amount using the same payment method you used to pay for your order. • For purchases made at the Maison La Prairie, please come and see us at the Maison. You shall also be able to exchange your Products.
Duty of inspection and notification of defects in case of defective Products
9.4 In case the Products sold to you by us have any defects upon delivery or handover, or do not conform with their respective descriptions, you may have certain statutory warranty rights. These statutory rights shall remain unaffected by our general return policy (as detailed in Articles 9.1–9.3 of these Terms and Conditions) or any other Articles of these Terms and Conditions. Please contact your local or national consumer protection agency for more information on you statutory rights.
9.5 You are obligated to inspect our Products to the extent that is feasible in the ordinary course of business. If the Products are defective, you must, without delay, contact the Maison La Prairie where you purchased the Products or our customer support team using the contact form on the contact page of our Website (available under Contact Us). If you do not do so, the Products shall be deemed accepted. In that case, you shall lose your warranty rights. Acceptance shall be assumed in any case if you do not submit a written notice of defect within 8 days after delivery. You may submit your notice of defect via email to customer support using the contact form on the contact page of our Website (available under Contact Us) or at the Maison La Prairie.
9.6 In case of defects which were unrecognisable following proper inspection pursuant to the Article above, please visit the Maison La Prairie where you purchased the Products immediately or contact our customer support team using the contact form on the contact page of our Website (available under Contact Us). The notice of defect should be submitted no later than 5 days after finding the defect; otherwise, the Products shall be deemed accepted with regard to such defect.
9.7 The defective Products must be returned together with a copy of the invoice and a description of the defect. You shall receive an email with the return address as soon as your written complaint has been received by the Customer support team. You may also return the Products at the Maison La Prairie where you purchased them.
9.8 You have statutory warranty rights regarding the remedy of defects. Such remedy shall, at our choice, consist of either repair of the defect (rectification) or the delivery of a Product that is free from defects (replacement). Any right to a reduction of the price shall be excluded.
9.9 Ownership to any replaced Products shall transfer to us upon delivery or handover at the Maison La Prairie. You shall be responsible for keeping the products safe and in good condition until they are delivered or handed over to us. We recommend that you return the Products via registered post and keep the receipt. We cannot remedy any defects of the Products if the Products are not returned to us or show additional damage when they arrive.
9.10 If the defects are not remedied pursuant to Article 9.8 of these Terms and Conditions, you shall have the right to withdraw from the Contract. Withdrawal based on non-substantial defects shall be excluded. If a service pursuant to Article 9.8 of these Terms and Conditions is not performed due to a non-substantial defect, all further warranty rights shall be excluded.
9.11 Any consequences of improper handling or storage of our Products or an damage to the Products caused by you or a third party as well as defects of our Products due to external circumstances shall be excluded from warranty. You shall e solely responsible for any such defects.
9.12 With the exception of the manufacturer warranties, no further statutory warranties or other guarantees shall be made. We shall not assume any liability or responsibility for any descriptions by third parties, particularly descriptions provided by other customers as part of product reviews published on our Website or in our social media channels.
9.13 The changes to any statutory warranty rights pursuant to Articles 9.4–9.13 shall also include, without limitation, all claims competing with the warranty rights, whether based on contract of sale (Art. 205, 206, 207, 208, 209, 210 Swiss Code of Obligations (Obligationenrecht, OR)), general contractual terms (Art. 97 et seq. OR), tort (Art. 41 et seq. OR), challenging the Contract for error (Art. 23 et seq. OR), etc. However, the exclusion of statutory warranty and liability rights pursuant to Articles 9.4–9.13 of these Terms and Conditions shall not apply if the damage was caused by us wilfully or through gross negligence or if we are bound by statutory liability. In addition, the disclaimer shall not apply to damages arising from loss of life, limb, or health.
10 Maison La Prairie Treatments and Purchase of Gift Vouchers
10.1 Online reservation To book a treatment online, please select from the available treatment categories and then choose your desired treatment (the “Treatment”). The buyer may then choose the date and time of the Treatment based on availability. Bookings may also be made directly at the Maison La Prairie or by calling us on the phone or sending an email. Payment shall be due on the day of the Treatment and shall be made by the buyer on location at the Maison La Prairie. To change or cancel a Treatment appointment, you must contact the respective Maison La Prairie at least 24 hours prior to the scheduled appointment. If you cancel a Treatment any later than 24 hours prior to the scheduled appointment, you shall be billed for 50% of the Treatment price. If you arrive late for a scheduled Treatment appointment, the Maison La Prairie shall be under no obligation to fully complete the scheduled Treatment. In case of another appointment directly following yours, the Maison La Prairie must shorten the duration of your appointment in order to ensure that any subsequent appointment can take place as scheduled. If you are more than 15 minutes late, your Treatment must be rescheduled. Your Treatment may only be administered if you complete and sign a customer consultation form stating important information which we need in order to assess whether the Treatment is appropriate for you or not. Based on the information provided, La Prairie may decide unilaterally to cancel, change, or reschedule the Treatment. La Prairie reserves the right to refuse to administer your Treatment if the Treatment were found to pose a risk for you or the person administering the Treatment, or in the case of violation of current spa policy or etiquette.
10.2 Purchasing of Gift Cards La Prairie sometimes offers gift cards for sale on our Website and at the Maison La Prairie. These gift cards may only be redeemed at the Maison La Prairie. When you purchase a gift card, you must confirm that you have read and accepted without reserve these Terms and Conditions as well as the terms which apply to the respective gift card category. To confirm the purchase of a gift card, you must state the name of the beneficiary of the gift card or Treatment. That beneficiary may be you or a third party. All gift cards are personal and non-transferable. The gift card contains a specific code which the Maison La Prairie can check whether the amount purchased has already been redeemed or the Treatment already administered. The gift cards shall be valid for three years unless another validity period has been stated for the respective gift card category. The validity period begins on the day on which the gift card was purchased. If the gift card is not redeemed within this validity period, neither the buyer nor the beneficiary shall have the right to a refund. 11. OUR LIABILITY
11.1 We shall not be liable for:
11.1.1 direct and indirect consequential damages such as loss of profit or third-party claims;
11.1.2 acts or omissions of our agents and contractors;
11.1.3 simple negligence.
11.2 We shall not be liable to you for loss of property, damage, loss of profits, loss of business, interruptions of operations, or loss of opportunity, and we shall not compensate for any third-party liability. This provision shall apply in particular if you fail to perform your obligations and use our Products for commercial, business, or reselling purposes (see Article 5.1.2 of these Terms and Conditions). Regarding the Services we recommend that you do not bring any valuables to your Treatment appointment.
11.3 Moreover, we shall not be liable for the improper storage or use of our Products or for storage or use of our Products contradictory to these Terms and Conditions, our instructions, or legal provisions.
11.4 We shall not be liable for any losses caused to you as a result of any delay or failure by us to perform our obligations where such delay or failure is due to an event which is beyond our reasonable control pursuant to Article 14 of these Terms and Conditions.
11.5 The disclaimer pursuant to Articles 11.11 and 11.2–11.4 of these Terms and Conditions shall not apply if the damage was caused by us wilfully or through gross negligence or if we cannot be otherwise held liable according to mandatory statutory provisions such as product liability. In addition, the disclaimer shall not apply to damages arising from loss of life, limb, or health (damage to persons).

14.2 If an event beyond our reasonable control occurs which affects the performance of our obligations under the Contract:
14.2.1 we shall try to contact you as soon as reasonably possible to notify you; and
14.2.2 our obligations shall be suspended and the deadline for the performance of our obligations shall be extended for the duration of the event beyond our reasonable control. Where the event beyond our reasonable control affects delivery of Products to you, we shall arrange a new delivery date with you after the event beyond our reasonable control has ended.
15. AMENDMENT OF THESE TERMS AND CONDITIONS
15.1 We may amend these Terms and Conditions from time to time (e.g. if we change our payment methods or if there is a change in the law that requires us to amend these Terms and Conditions).
15.2 Every time you make a purchase at a Maison La Prairie or order Products or Services from our Website, the Terms and Conditions in force at that time shall apply to the Contract between you and us. If we waive your non-performance, we shall only ever do so in writing, and that shall not automatically imply a waiver of any non-performance on your part at a later date.
17.5 Together with the shipping confirmation, these Terms and Conditions shall constitute the entire Contract between you and us with regard to the object of the Contract and shall replace any and all prior Contracts between you and us with regard to the object of the Contract.
18. GOVERNING LAW AND PLACE OF JURISDICTION
18.1 These Terms and Conditions shall be governed by Swiss substantive law excluding the United Nations Convention on Contracts for the International Sale of Goods and conflict of laws rules.
18.2 You and we both agree that the courts of Zurich, Switzerland, shall be the sole place of jurisdiction for any and all disputes arising in connection with these Terms and Conditions. The foregoing shall not apply if the disputed matter is a consumer contract. In that case, the court at your place of residence or our registered office shall be responsible for any lawsuit filed by you. Our lawsuits shall be filed exclusively with the court in your place of residence.
