We are La Prairie Group AG, a company registered in Switzerland with company registration number CHE-106.320.403 and with UK VAT number 181010359, and we operate the website www.laprairie.com ("Website"). Our principal place of business is at Bellerivestrasse 36, 8008 Zürich, Switzerland.

These terms of use ("Website Terms of Use / Terms of Use") set out the legal terms and conditions on which we allow you to access our Website (whether as a registered user or as a guest). By accessing, browsing or otherwise using our Website, you accept these Terms of Use, without limitation or qualification. If you do not accept these Terms of Use, you are not entitled to access or use the Website and you should leave the Website immediately.

Please note that if you purchase any Products from our Website, you will enter into a legally binding contract of sale with La Prairie (UK) Limited which is a different company within the La Prairie Group, and your purchase would be governed by additional Terms and Conditions. The Terms and Conditions apply in addition to these Terms of Use, not instead of them. If you have any questions or concerns relating to an order that you have placed, please refer to our Terms and Conditions.

1.  UNDERSTANDING THESE TERMS OF USE

1.1           When certain words and phrases are used in these Terms of Use, they have specific meanings (these are known as "defined terms"). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the article of these Terms of Use where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks).

1.2           When we refer to "we", "us" or "our", we mean La Prairie Group AG. When we refer to "you" or "your" we mean you, the person accessing or using our Website. Our Website is offered to and made available to consumers only (and not to business buyers). You are a consumer if you are a natural person and you are acting for purposes that are wholly or mainly outside of your trade, business, craft or profession.

2. OUR WEBSITE

2.1           Our Website is made available free of charge. We do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. Access to our Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Website without notice. We will not be liable to you if for any reason our Website is unavailable at any time or for any period. We may update the Website and/or change the content on it at any time. The foregoing rights of La Prairie shall not affect your legal rights, in particular, in relation to an order you have already placed.

2.2           You are responsible for making all arrangements necessary for you to have access to our Website. You are also responsible for ensuring that all persons who access our Website through your internet connection are aware of these Terms of Use and that they comply with them.

2.3           The Website and the content on it are provided for general information and entertainment purposes only. They are not intended to amount to advice (medical or otherwise) on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our Website.

3. YOUR ACCOUNT AND PASSWORD

3.1           In order to register an account with us, you must be aged eighteen (18) or over.  

3.2           If you register an account with us, you will be asked to provide your email address and password as part of our security procedures. You must treat such information as confidential and you must not disclose it to any third party.

3.3           We have the right to disable any accounts and/or passwords, at any time, if you have failed to comply with any of the provisions of these Terms and Conditions.

4. OUR RIGHTS

4.1           We are the owner or licensee of intellectual property rights on the Website and its content, the La Prairie name and mark and La Prairie's product names, images and packaging. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

4.2           You are not granted any right to use, and may not use, any of the intellectual property rights that we own or that have been licensed to us other than as set out in these Terms of Use. You must not use our Website (or any part of it or its content) for commercial purposes; however, you may download material from the Website solely for non-commercial, personal use by you.

4.3           No part of the Website, including, without limitation, the text, designs, graphics, photographs and images contained in it, may be copied, reproduced, republished, uploaded, re-posted, modified, transmitted or distributed or otherwise used in any way for any nonpersonal, public or commercial purpose without our prior written consent.

4.4           By sending us any feedback, comments, questions, ideas, proposals, or suggestions concerning La Prairie or any of our Website whether online, by email, by postal mail, or otherwise (collectively, “Feedback”), you represent and warrant (i) that you have the right to disclose the Feedback, (ii) that the Feedback does not violate the rights of any other person or entity, including, but not limited to, intellectual property rights, such as infringing a copyright, trademark, or patent; violating a right of privacy, attribution or withdrawal; or otherwise misappropriating a trade secret, and (iii) that your Feedback does not contain the confidential or proprietary information of any third party or parties. By sending us any Feedback, you further (1) agree that we are under no obligation of confidentiality, express or implied, with respect to the Feedback, (2) acknowledge that we may have something similar to the Feedback already under consideration or in development, and (3) grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license, under all intellectual property rights, to use, make, have made, incorporate into our Website, modify, copy, display, perform, distribute, prepare derivative works, publish, distribute, and sublicense the Feedback, without any credit or compensation to you. This Feedback section shall survive any termination of your account or any aspect of the Website.

5. OUR LIABILITY

5.1           Please note that this article 5 applies to our liability to you in respect of the operation of the Website (only) and it does not apply to any sale of Products to you. Different limitations and exclusions of liability will apply to liability arising as a result of the sale of any La Prairie Products by us to you - these limitations and exclusions are set out in article 9 of our Terms and Conditions.

5.2           Nothing in these Terms of Use excludes or limits our liability for:

5.2.1           death or personal injury caused by our negligence;

5.2.2           fraud or fraudulent misrepresentation; and

5.2.3           any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

5.3           If we fail to comply with these Terms of Use, we are responsible for your actual, proven and direct loss or damage that you suffer that is a result of our breach of these Terms of Use or our negligence, but we are not responsible for any loss or damage that is unforeseeable, indirect and consequential. 

5.4           Nothing in these Terms of Use affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.

5.5           We only supply the Website for domestic and private use. You agree not to use the Website, or any content on the Website, for any commercial or business purposes.  Accordingly, we are not liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

5.6           The Website may from time to time contain links to third party websites. You are responsible for deciding whether to access a third party website and your use of third party websites will be governed by the terms and policies of that third party website. We assume no responsibility for the content of websites to which we link from our Website. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

6. VIRUSES

6.1           We do not guarantee that our Website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our Website. We recommend that you use your own virus protection software.

6.2           You must not misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Website, the server on which our Website is stored or any server, computer or database connected to our Website. You must not attack our Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities. We will co-operate with those authorities and, where permitted by law, we may disclose your identity to them. In the event of such a breach, your right to use our Website will cease immediately.

8. GOVERNING LAW AND JURISDICTION

8.1           These Terms of Use are governed by English law. This means that your access to and use of the Website and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims) will be governed by English law.  

8.2           You may bring any dispute which may arise under these Terms of Use to, at your discretion, either the competent court of England, or to the competent court of your country of habitual residence if this country of habitual residence is within the UK, which courts are (with the exclusion of any other court) competent to settle any of such a dispute. We shall bring any dispute which may arise under these Terms of Use to the competent court of your country of habitual residence.

8.3           As you are a consumer resident in the UK, you will benefit from any mandatory provisions of the law of the country in which you are resident and nothing in these Terms of Use affects your rights as a consumer to rely on such mandatory provisions of local law.

These terms and conditions (together with our Privacy Policy and Website Terms and conditions) ("Terms and Conditions") set out the legal terms and conditions applicable to purchases and orders of La Prairie products ("Products") in our La Prairie brick and mortar stores operated by us ("La Prairie Boutiques") as well as for online orders on our website www.laprairie.com ("Website") to our clients ("Client" or "you"), in the version current at the time of purchase or making the order. In case of discrepancies between provisions in these Terms and Conditions, in our Privacy Policy and/or our Website Terms of Use the provisions of these Terms and Conditions shall prevail. Nothing in these Terms and Conditions affects your rights as a consumer to rely on any mandatory provisions of English law. These Terms and Conditions do not apply if you buy Products from any source other than our La Prairie Boutiques or our Website (if, for example, you buy Products from one of our authorized distributors or retailers). The distributors and retailers will have their own terms and conditions that will apply if you buy Products from them (and you should make sure you understand any such terms).

In case of ordering our Products from our Website we recommend that you print or save a copy of these Terms and Conditions for your records (but please note that we may amend these Terms and Conditions from time to time, as explained in article13 below). In case of purchasing our Products in La Prairie Boutiques we recommend that you take the provided Terms and Conditions with you. Please consult our Terms and Conditions each time you make a purchase or order Products to ensure you understand the legal terms that will apply to the Contract at that the time of your purchase or your order.

2.              OUR PRODUCTS

2.1           Our range of Products are intended to help prolong the youthful appearance of the delicate skin by confronting the problems of premature aging, environmental hazards and the stress of contemporary life. For more information on our Products (including their benefits, how they should be applied and perfect partner products to compliment your chosen Product) please visit the Collections page on our Website (available at Collection Overview).

2.2           The images of the Products on our Website are for illustrative purposes only. The packaging and presentation of the Products at La Prairie Boutiques or upon delivery of our Products to you may vary slightly from that shown on images on our Website.

2.3           Many of our Products are available in different sizes, weights, quantities and varieties. The various options for each Product are stated on the relevant Product page on our Website.

2.4           All Products shown on our Website are subject to availability. We will inform you by email if the Product you have ordered is not available and we will not process your order if made.

3.              YOUR ONLINE ACCOUNT

3.1           You do not have to register to explore our Website or to buy or order Products from us. However, if you chose to register and create an account with us, this will enable us to customise your experience, making shopping easier for you. Please see article 3 of our Terms of Use for the rules on setting up an account.

3.2           By creating an account, you can store and edit your delivery addresses and billing information and review your previous purchases and order history. We can also access this information for your convenience, when you make a purchase in La Prairie Boutiques.

3.3           When you register or buy Products through our Website, you will be required to provide certain information including your name, phone number, delivery address and email address. You will also be required to provide valid details of a credit or debit card which you are legally entitled to use. We reserve the right to request additional evidence or proof of billing information where necessary. You confirm that all information you provide to us at any time is true, accurate and complete.

4.              CONCLUSION OF A CONTRACT

4.1           General Information

4.1.1           You may only buy Products from us, either on our Website or in La Prairie Boutiques, if you are at least 18 years old. If you are not at least 18 years old, we assume the consent of the legal representative to your purchases.

4.1.2           We only supply Products (including any free samples provided with your order or handed over at La Prairie Boutiques) for domestic and private use. You may not buy Products from us, neither on our Website nor in La Prairie Boutiques, for resale or any other commercial purposes.

4.2           Purchase on our Website

4.2.1           If you order our Products on our Website our ordering process allows you to check your order and amend any errors before submitting your order of our Products to us. Please take the time to read and check your order at each stage of the ordering process. In particular, please check the quantities, sizes and weights of each of the Products in your order.

4.2.2           By clicking the "Submit order"or any similar button you are committing to buy and pay for the Products in your order, and you will be required to confirm that you accept and agree to be bound by these Terms and Conditions.

4.2.3           The submitted order is an offer from you to us to enter into a Contract to buy the Products in your order. Your offer can be freely accepted or rejected by us. After you place an order, you will receive an email from us acknowledging that you have placed an order. Please note that this does not mean that your order has been accepted. The Contract is only concluded when we send you a separate email with shipping confirmation ("Shipping Confirmation"). A new Contract is concluded (on the issuance of the Shipping Confirmation) for each order placed, and each Contract will be subject to the version of these Terms and Conditions that exists at the time the relevant order is placed.

4.2.4           Only the Products listed in the Shipping Confirmation are included in the Contract between you and us. If there are any errors in your Shipping Confirmation, please contact us as soon as possible using the form on the Contact Us page on our Website (available at Contact Us).

4.2.5           If we are unable to supply you with a Product (because, for example, that Product is not in stock or is no longer available) we will inform you of this by email. If you have already paid for the Product(s), we will refund you the full amount. 

4.2.6           The order process is only available in the English language.

4.2.7           We will not file a copy of any contract formed between you and us.

5.              PRODUCT PRICES

5.1           The prices of the Products will be as shown in La Prairie Boutiques (if you buy the Products there) or as quoted on our Website at the time of your purchase or order (when you buy online). In case we have to ship the Products to you, the prices are subject to applicable delivery charges – which will be made clear to you prior to checkout.

5.2           We take all reasonable care to ensure that the prices of the Products displayed in La Prairie Boutiques or shown on our Website are correct. However, it is always possible that, despite our efforts, some of the Products may be incorrectly priced. If the price for the Product displayed in La Prairie Boutiques is obviously incorrect, we have the right to withdraw from the Contract. In this case, once you have returned the Products to us, we will refund you the paid price, if applicable. You will have the opportunity to purchase the Products at the right price. If we discover an obvious error in the price of the Products you have ordered online we will contact you to inform you of this error and we will give you the option of continuing to purchase the Products at the correct price or cancelling your order. Even if a Shipping Confirmation has already been sent to you, we do not have to provide the Products to you at the incorrect price and, in any case, reserve the right to withdraw from the Contract. We will not process or ship your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat your order as cancelled. For clarity and the avoidance of doubt, we reserve the right, without prior notice, to (i) correct any errors, inaccuracies, or omissions, and (ii) change or update information or cancel orders, if any information in the Website or displayed in La Prairie Boutiques is inaccurate at any time (including after you have submitted an order).

5.3           The prices of the Products may change from time to time, either on our Website as well as in La Prairie Boutiques. Such price changes will not affect any order already placed. 

6.              METHODS OF PAYMENT

6.1           You can pay for Products using a credit card, PayPal, Apple Pay, Google Pay, Klarna, or Alipay. We accept the following cards: Visa, MasterCard, Maestro, American Express, China Union Pay.

6.2           By ordering Products from us, either through our Website or in La Prairie Boutiques, you authorise us to perform credit and anti-fraud checks on you and the payment method that you have chosen. These checks may be required, amongst other things, to verify your identity, to validate your credit or debit card, to obtain an initial credit or debit card authorisation and/or to authorise individual purchases. You authorise us to disclose information provided by you, including personal information, to third parties such as banks and the providers of credit reports for the purposes of these checks. You accept that such parties may keep a record of that information. You also agree that we may make the information we receive from such checks available to third parties including fraud prevention and credit reference agencies. We reserve the right to put in place additional payment security systems from time to time. For further information on how we process your data please refer to our Privacy Policy.

6.3           If the amount due from you for your order cannot be debited or charged, for whatever reason, your order will be cancelled (we will try to notify you of this using the contact details you provided during the order process).

6.4           If we have to ship your purchase or order, your debit card or credit card will not be charged until we ship your purchase or your order (at which point we take payment for the Products and all applicable delivery charges in full).

7.              DELIVERY OF YOUR ORDER & TRANSFER OF RISK

7.1           We will make best efforts to ensure that tour order will be fulfilled by the estimated delivery date set out in the Shipping Confirmation. If we are unable to meet the estimated delivery date because of an event outside of our control, we will contact you with a revised estimated delivery date.

7.2           Delivery will be completed and our obligations are fulfilled when the Products are successfully delivered to the address you gave us. After delivery, the risk of accidental deterioration and accidental loss of the Products passes on to you. Please make sure that the delivery details you provide are accurate as we cannot be responsible for any delayed or failed deliveries as a result of your error. 

7.3           If you order Products from our Website for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount. You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

7.4           You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such laws or regulations. 

8.              CANCELLATION, RETURNS AND REFUNDS

8.1           We want you to be completely satisfied with the Products you have ordered from us. If you have any problems with the Products you have ordered, please contact our customer services team using the form on the Contact Us page of our Website (available at Contact Us). 

8.2           Details of your legal right to cancel your Contract with us and an explanation of how to do this, and your other rights of return, are set out below and provided in the Shipping Confirmation that we send to you.

8.3           Cancellation/changes to an order

8.3.1           You have a legal right to change your mind and cancel a Contract within fourteen (14) days of delivery of your Products without needing to give us a reason. La Prairie offers an enhanced right of return to extend this time period to thirty (30) days (this goodwill extension of your rights of cancellation may be revoked or changed by La Prairie in the future, but this will not affect your legal right as described). This right is explained in more detail below.  

8.3.2           Please note that the right of cancellation in article 8.3.1 does not apply to:

8.3.2.1          any bespoke Products you purchase from us, meaning Products that we create to your specification or are clearly personalised; or

8.3.2.2          cosmetic products (or any other sealed goods that are not suitable for return due to health protection or hygiene reasons) that have been opened or on which the hygiene seal has been broken (if applicable).

8.3.3           The enhanced cancellation period will expire thirty (30) days from the date on which you acquire (or a third party other than the carrier and indicated by you acquires) physical possession of the Products. You may cancel the Contract in respect of all Products delivered or in respect of certain of the Products only. Where you order multiple Products in one order or a Product is delivered in separate parts, lots or pieces, the enhanced cancellation period will expire thirty (30) days from the day on which you acquire (or a third party other than the carrier and indicated by you acquires) physical possession of the last Product, part, lot or piece that makes up your order.  

8.3.4           To exercise the right to cancel, you must inform us of your decision to cancel the Contract with us by making a clear statement. The easiest way to do this is to contact our Customer Services team, whose contact details can be found in article 14. You may alternatively use the following model cancellation form but you are not required to do so:

8.3.5           To meet the cancellation deadline, it is sufficient for you to send your communication concerning the exercise of your right to cancel before the cancellation period has expired.

8.3.6           We will send you an acknowledgement of receipt of your notice to cancel by email.

8.3.7           If you wish to exercise your rights to a refund under this article 8, you must return those Products in accordance with article 8.5:

8.4           Other rights of return 

8.4.1           You have legal rights in relation to Products that are not as described, faulty or otherwise not fit for purpose. These legal rights are not affected by our general returns policy / your rights of cancellation (as set out in clause 8.3 above). Advice about your legal rights is available from your local or national consumer protection body.

8.4.2           If you believe that any Products that you have ordered do not conform with these Terms and Conditions Sale, please contact our Customer Services Team to request a replacement or refund.

8.5           How to action a return

8.5.1           USE A PRE-PAID SHIPPING LABEL - Please complete the return form included with your shipment and repack the unused portion, in its original packaging and enclose the completed form.

8.5.2           Affix the UPS pre-paid shipping label with the transparent pouch and call UPS at +44 (0)8457 877 877 to pick up the parcel at your address or give the package to UPS by using the UPS Store, UPS drop box or any UPS driver. Please allow fourteen (14) business days from receipt of package for processing.

8.5.3           All returns should be returned to:

8.5.4           We will pay the costs of return if the Products are faulty or misdescribed in accordance with article 8.4. In all other circumstances, you must pay the costs of return.

8.5.5           The goods must be in their original packaging, complete with all accessories and accompanied by the invoice, the completed delivery note/return slip, and any guarantee certificate, if applicable. Sealed and plastic-welded products can only be returned when unopened.

8.5.6           If you return a product or products in an order, then you must also return any exclusive offer/gift with purchase (“GWP”) that you may have received with that order, or you will be charged the full value of the GWP.

8.5.7           You are responsible for taking reasonable care of the Products until they are returned to us. We recommend that you return them to us using a recorded delivery service and that you keep proof of postage. We will be unable to provide you with a full refund if the Products are not returned to us or if they are damaged when they arrive.

8.6           Refund payments

8.6.1           If a refund is due to you in accordance with these Terms and Conditions (or applicable law) you will receive a full refund of the price you paid for the Products.

8.6.2           We will make the refund without undue delay, and not later than:

8.6.2.1          fourteen (14) days after the day we receive back from you any Products supplied;

8.6.2.2          (if earlier) fourteen (14) days after the day you provide evidence that you have returned the Products; or 

8.6.2.3          if there were no Products supplied, fourteen (14) days after the day on which we are informed about your decision to cancel this Contract.

8.6.3           We may withhold reimbursement until we have received the Products back or you have supplied evidence of having sent back the Products, whichever is the earliest.

8.6.4           We will make the refund using the same means of payment as you used for the initial transaction. You will not incur any fees as a result of the refund.

9.              OUR LIABILITY

9.1           Please note that this article 9 applies to our liability to you in respect of purchases of Products that you make online on our Website and it does not apply to your use of the Website (or your account) more generally. Different limitations and exclusions of liability will apply to liability arising as a result of your use of our Website - these limitations and exclusions are set out in article 5 our Terms of Use.

9.2           Nothing in these Terms and Conditions excludes or limits our liability for:

9.3           If we fail to comply with these Terms and Conditions, we are responsible for your actual, proven and direct loss or damage that you suffer that is a result of our breach of these Terms and Conditions or our negligence, but we are not responsible for any loss or damage that is unforeseeable, indirect and consequential. 

9.4           Nothing in these Terms and Conditions affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.

9.5           We only supply the Website and offer Products for sale for domestic and private use. You agree not to use the Website or to make any purchases of Products for any commercial or business purposes.  Accordingly, we are not liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

12.           EVENTS OUTSIDE OF OUR CONTROL

12.1        In rare circumstances, events outside of our reasonable control may delay or prevent us from performing our obligations. If these events occur, we will try to perform our obligations to you as soon as we can. We cannot, however, accept liability for any losses caused to you as a result of any delay or failure by us to perform our obligations where such delay or failure is due to an event which is outside of our reasonable control.

12.2        If an event outside of our reasonable control takes place that affects the performance of our obligations under the Contract:

12.2.1       we will try to contact you as soon as reasonably possible to notify you; and

12.2.2       our obligations will be suspended and the time for performance of our obligations will be extended for the duration of the event outside of our reasonable control. Where the event outside of our reasonable control affects delivery of Products to you, we will arrange a new delivery date with you after the event outside of our reasonable control is over.

13. CHANGES TO THESE TERMS AND CONDITIONS

13.1        We may make changes to these Terms and Conditions from time to time (if, for example, we have made changes to how we accept payment from you, or if there is a change in the law that means we need to change these Terms and Conditions). This will not affect any order already placed and the version of the Terms of Sale that existed when you placed that order will still apply, unchanged, to that order.

13.2        If you are a Registered User and we wish to make changes to these Terms of Sale, we will endeavour to provide you with at least thirty (30) days’ advance notice (unless the change is due to a change in law or for security reasons, in which case we may need to make the change on shorter notice). If you do not wish to continue using the Website following the changes, you may close your Account with us. 

13.3        Every time you make a purchase in La Prairie Boutiques or order Products from our Website, the Terms and Conditions in force at that time will apply to the Contract between you and us. The current version of these Terms and Conditions will be available on our Website or in La Prairie Boutiques. Please check the Terms and Conditions each time that you purchase or order Products from us to ensure that you understand the Terms and Conditions that apply at the time.

14.           COMPLAINTS / CONTACT US

14.1        We hope that you don't have cause for a complaint but, if you do, we want to hear about it so that we can try and resolve it and make sure it doesn't happen again. Please contact our client services team using the form on the Contact Us page on our Website (available at Contact Us). 

14.2        If you have bought the Product in one of our La Prairie Boutiques you can also visit La Prairie Boutiques and tell us your complaint in person.

15.           GOVERNING LAW AND JURISDICTION

15.1        These Terms and Conditions are governed by English law. This means that your purchasing of Products, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims) will be governed by English law.  

15.2        You may bring any dispute which may arise under These Terms and Conditions to, at your discretion, either the competent court of England, or to the competent court of your country of habitual residence if this country of habitual residence is within the UK, which courts are (with the exclusion of any other court) competent to settle any of such a dispute. We shall bring any dispute which may arise under These Terms and Conditions to the competent court of your country of habitual residence.

15.3        As a consumer and are resident in the UK, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms and Conditions affects your rights as a consumer to rely on such mandatory provisions of local law.

FULFILLING OUR RESPONSIBILITY IN THE SUPPLY CHAIN

Modern Slavery and Human Trafficking statement pursuant to section 54 of the UK Modern Slavery Act 2015 

Introduction

At La Prairie (UK) Ltd. (“La Prairie UK” or “we”) we want to play an active role in making positive contributions to society. La Prairie UK acknowledges that as being part of a global corporate organisation it has a responsibility to address, and seek to eliminate, the risk of slavery and human trafficking in its operations, in line with the principles contained in the United Nations Universal Declaration of Human Rights and the UK Modern Slavery Act 2015.

In this statement, we set out La Prairie UK’s commitment to taking steps to identify and eradicate slavery and human trafficking from its business and from its supply chains. We do not tolerate slavery and human trafficking within the supply chain or within any part of our business.

As required by the UK Modern Slavery Act 2015, this statement reports on the steps La Prairie UK and the La Prairie group have taken in this regard during the financial year ended 31 December 2024.

Structure and Supply Chains

La Prairie UK, based in London, as part of the La Prairie Group is also part of the Beiersdorf Group, a global leader in the consumer goods industry. La Prairie UK’s principal activity is sales, marketing and distribution of luxury cosmetic products under the LA PRAIRIE brand. Regarding La Prairie finished products, supply chain processes take place predominantly within Europe. Regarding goods and services not directly related to the production of La Prairie finished products, in 2024, 98% of the spend of La Prairie UK was with suppliers located in the UK and 2% with suppliers located outside of the UK within Europe.

Driving Sustainability through Cooperation and Transparency

La Prairie Group seeks and promotes long-term business relationships with suppliers who are actively committed to our principles of sustainable and responsible corporate governance. We source raw materials, packaging materials, and other goods and services from around 3,500 suppliers in over 50 countries. 

We require our business partners throughout the supply chain to commit to meeting our standards – not only in terms of the material and product quality we require, but also with regard to conducting their business in a transparent, fair, and responsible way. We assess that our suppliers meet their social, environmental, and economic responsibilities –and ensure that our consumers receive innovative, high-quality products.

Our Codes of Conduct for Business Partners and Employees and Compliance Program

We require both our employees and our business partners to uphold and promote human rights. All La Prairie UK employees are provided with a Code of Conduct for Employees. In addition, all the employees are trained on the Code of Conduct for Employees. The Code of Conduct for Employees is designed to help employees understand the company’s principles and act in accordance with them. Diversity and equal opportunities are an essential part of the Code of Conduct. The Code of Conduct also clearly states that La Prairie UK does not support or tolerate slave labour, child labour or human trafficking. La Prairie UK also stands for fair working conditions and promotes physical and mental health and safety at work.

We require our partners along the supply chain to adhere to our Code of Conduct for Business Partners (CoC). The CoC obliges our suppliers to comply with the same high standards as our parent company and subsidiaries in all production facilities and processes. The CoC for Business Partners defines uniform and binding criteria for responsible business conduct. It regulates critical aspects such as the prohibition of corruption, child labour, forced labour, and discrimination; at the same time it actively promotes occupational health and safety, the right to freedom of association and collective bargaining, and environmental protection.

Our CoC for Business Partners is based on the principles outlined under the UN‘s Universal Declaration of Human Rights, the conventions of the International Labour Organisation (ILO), the OECD Guidelines for Multinational Enterprises, the principles of the UN Global Compact, and the general principles pertaining to Anti-Corruption and Competition Laws.

Code of Conduct for Business Partners and risk assessment

Signed recognition of the CoC is the first crucial step in ensuring that La Prairie UK’s suppliers adopt and implement similar standards of excellence and responsibility. 

In addition, we also conduct an initial risk analysis of our relationship with our Business Partners The risk analysis considers industry risks, country risks and individual risks of the supplier, such as the economic significance to La Prairie group. The higher the risk, the more extensive our analysis. Additionally, we require our business partners above a certain risk class to conduct an assessment via the international collaboration platforms Sedex or EcoVadis. The Sedex platform enables suppliers to provide their customers with the most important data concerning their sustainability approach and processes and assesses Business Partners based on information from reliable sources, such as international organisations. 

Thanks to the high level of transparency this ensures, together with the supplier we can identify critical aspects or processes and jointly improve sustainability within the framework of our cooperation. 

Based on the results we then decide whether a Responsible Sourcing Audit according to the SMETA 4-pillar audit protocol is required for the supplier. To ensure the objectivity of the investigation, the audit is carried out by an independent and certified third-party specialist. If the audit reveals a need for remediation, we would actively support the business partner in defining and rapidly implementing appropriate measures.

Supply Chain Due Diligence Training for Business Partners   

In the spirit of partnership, we also offer and encourage our suppliers and business partners to complete an E-Learning entitled “Supply Chain Due Diligence Training for Business Partners”. The training includes a comprehensive overview of supply chain due diligence and how to ensure the safeguarding of human rights within their areas of operation. It is broken down into multiple modules and lasts about 45 minutes.  

Each module contains key messages about various business-related aspects of human rights, as well as the obligations for companies resulting from related legislation and regulation. Additionally, this training will provide tools and examples of how to incorporate the aforementioned requirements into their organization and supply chain. 

Reporting mechanisms 

La Prairie UK provides an opportunity and expects Business Partners and their employees to report any breach of our CoC for Business Partners or the applicable laws related to La Prairie UK in good time after learning of the breach. This also includes breaches committed by the Business Partner’s subcontractors and suppliers along the supply chain. Such reports can be made as follows: 

•      by contacting the Business Partner’s primary contact at La Prairie UK

•      via e-mail (Incidents_Cases@Beiersdorf.com) or

•      anonymously over the Beiersdorf incident reporting platform Speak up. We care
